Prohibited Uses

You must not:

• Impersonate others

• Interfere with Service operation

• Upload malicious code

• Attempt unauthorized access

• Launch denial of service attacks

• Reverse engineer our Services

• Circumvent security measures

Parent and Child Responsibilities

Parent/Guardian Responsibilities

Parents or guardians who authorize children’s use of our Services acknowledge and agree:

• They are solely responsible for monitoring their child’s online activity

• Our AI monitoring is a supplementary tool and not a replacement for parental supervision

• They will promptly review and respond to safety notifications

• CYBERSAFELY.ai services may not detect all concerning content

• Service performance depends on internet connectivity, device functionality, and proper installation

• They will educate their children about the presence and purpose of monitoring tools

Limitations of AI Monitoring

Our Services:

• Cannot detect all potentially harmful content

• Are not a substitute for emergency services

• May not function if internet connectivity is lost

• Can be affected by technical malfunctions

• Depend on proper installation and usage

• Rely on probability-based AI detection that improves over time but is not infallible

Emergency Situations

In cases of imminent danger or emergency situations:

• Contact emergency services (911) immediately

• Do not rely solely on our monitoring tools

• Follow appropriate crisis protocols

Content Standards

All Website and Service usage must:

• Be legal

• Be truthful

• Respect rights of others

• Not be harmful or offensive

• Not promote illegal activities

• Not be misleading

• Not cause technical issues

Geographic Restrictions

• Services are for U.S. users only

• Access from other locations is at user’s risk

• Users must comply with local laws

• Continuous operation of monitoring services

• Detection accuracy for novel threats

• Performance during internet outages

• Monitoring effectiveness for all communication types

• Functioning on all device types and configurations

Security Disclaimers

WE ARE NOT LIABLE FOR:

• Denial-of-service attacks

• Viruses

• Other harmful materials

• Data loss

• Service interruptions

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

• Direct damages

• Indirect damages

• Consequential damages

• Special damages

• Punitive damages

• Lost profits

• Lost revenue

• Lost data

• Service interruption

• Computer damage

• Harm resulting from undetected dangerous content

• Failure to generate safety notifications

Legal Disputes

Governing Law

• Ohio law applies

• Without regard to conflicts of law principles

Venue

• Federal courts in Cleveland, Ohio

• State courts in Cuyahoga County, Ohio

Arbitration

All disputes arising under or in connection with this agreement shall be resolved through binding arbitration conducted under the rules of the American Arbitration Association. The arbitration shall:

• Be conducted in Cleveland, Ohio

• Apply Ohio law

• Be binding and final

• Be conducted on an individual basis only

Class Action Waiver

By using our Services, you waive any right to:

• Participate in a class action lawsuit

• Join claims with others similarly situated

• Bring any claim as a representative of a class

Time Limitation

Claims must be filed within ONE (1) YEAR after accrual.

Miscellaneous

Waiver

No waiver of any term implies waiver of other terms.

Severability
